Hi,
I posted the below in another forum and I think I put it in the wring spot. Anyway, here is my question:
I am thinking about starting a Casino site. I have scouted one out and am interested in purchasing this. My question is this. I am located in Ontario, Canada, are there any legal implications that I should take into consideration?
I currently have 2 other website (not casino's) up, so I do have a host already, but I am not sure what the regulations are as far as starting a site like this one.
Basically what I am purchasing is a site that is linked to another site (in essence a 'Mother' site), it is already developed and I would simply have to market the site. Then I get a percentage of the wagers that people who have registerred through my site have bet.
Any advice would be very welcome. As well if I have placed this in the wrong forum please let me know as I was not too sure where to put this.

1. DO NOT host your site in USA
2. DO NOT sell your service to people living in USA.
If you do this then NEVER visit USA.
3. I heard that Canada banks follow what USA govt tell them to follow so you may like to keep your money outside Canada. Or better keep yourself out of Canada.
FYI, I don't have any casino site. The above 3 points are based on my online knowledge.
4. Talk with your lawyer.

No - not true.
Canadian banks will, within our laws, comply with requests for information made in select circumstances.
We are, after all, our own country with our own laws.
If the DoJ requests info from a Canadian company, it's that company's choice whether to respond or not - the DoJ has NO jurisdiction in Canada.
A bank may choose to comply, however, to avoid any bad publicity, etc.
As for the crack-downs in this industry, the DoJ is targeting those who were the "founders" of things, basically. The average Joe who placed a few bets has little, if anything, to fear from this. The banks have sufficiently insulated themselves over the years to be seen solely as "intermediaries" in this whole thing - and past DoJ actions against banks resulted in nada, so they don't really focus in on them these days.
The bottom line is this:
if it's a new venture, it'll cost tens of thousands of dollars in marketing to attract any business...and you'd best be targeting those outside the US only. You DO NOT want to be a Principal of a new, US-targeting casino or sportsbook - just draw a target on your back.

Thanks for the replies.
OK, I have inquired to the company that I am thinking of purchasing this from and this was their response:
1. These casino site is turnkey sub-licenser casino site. You dont need the license for it. You just need a brand name then promote it, your licenser will handle everything. So you will have no problem about legal matter.
This was in answer to a question I had asked about the legalities of having this given I am in Canada. I will need to purchase a domain name and they will then apply the site to this domain I have given them, directly through my webhost.
Currently I am using Netfirms.ca as my webhost and again, the biggest concern right now is the legal implications. I have given alot of thought to the Marketing, but of course any legalities have to come first.
Based on the answer I received from the seller, is there something else I should be looking for?

I would not pursue this - it's a cookie-cutter template and it's likely many others are already in operation.
The bottom line remains the same - it's YOUR website, so if the US authorities go looking for someone because YOUR site is targeting Americans, YOU are on the hook - NOT the hosting company - it's perfectly legal for them to host such a site in Canada - it's NOT legal for you to try to target Americans to generate revenue through online gambling.
I'm not sure how else to say this, but this idea is not a good one to pursue at this time IF you will, in any way, be targeting Americans.
I'm not saying these things to discourage you, and my information is not based on "reading" things. I know the industry well, though I do not operate any properties you can wager at.
